THE NICHOLAS COLIN OLIVIER WATNEY FRAUD CASE : REPORT NO. 16

On Tuesday, 27th April 2004 Dr. Harrop called me at 10.54 a.m. in the morning on my cell phone. He told me that he was calling me from London. The number Dr. Harrop was calling me from was undisclosed on my cell phone and I could therefore not note it (see report of 25th April 2004).

Dr. Harrop told me that he was displeased that I had not arranged to receive “the response” of  Suresh Jasraj Seth, holder of EABL shares account No.
XXXXXXXX, on Friday, 23rd April 2004 at 11.00 a.m., even though he had notified me to do so. He told me the person he had sent to deliver the documents was “interrogated” and asked several “embarrassing” questions for about five minutes. Dr. Harrop said that he detected that the the matter had raised suspicions at Barclays Advisory and Registrar Services Limited and suggested that we drop the “venture” if this was the case, repeating what he had told me on Thursday, 22nd January 2004 (see report of 12th March 2004).

Dr. Harrop suggested that I was failing in my role of keeping him and Mr. Shah constantly updated on the position at Barclays Advisory and Registrar Services Limited. He told me that this was a costly lapse that they could not afford.

I on my part apologised for the lapse of Friday, 23rd April 2004 and told Dr. Harrop I had not wanted to appear to have a direct involvement in the matter, to avoiding raising suspicions. Dr. Harrop’s call was unexpected but I nevertheless kept as best a composure as possible.

Dr. Harrop told me that he would be in Kenya in the week of 2nd May 2004 to 8th May 2004 as opposed to what he told me on Friday, 23rd April 2004 i.e. that he would be in Kenya in the week of 25th April 2004 to 1st May 2004. He concluded by emphasising that we ought to drop the “venture”, if it had raised suspicions at Barclays Advisory and Registrar Services Limited.

Dr. Harrop could certainly sense that something was “wrong” and I tried to calm him as best as possible.
