KENYANS DESERVE A RESPONSIBLE GOVERNMENT OF THE PEOPLE
A Petition

Monday, March 06, 2006

Whereas it is now clear that the main impediment in forming a clean government is the apparent corrupt activities involving the current and prior administrations and some in the opposition, and given these circumstances, it is doubtful that those in power have the moral authority or will to resolve the crisis currently facing Kenya to the satisfaction of Kenyans due to the varied interests that are competing for dominance. Kenyans have an abiding obligation to selfishly guard the democratic space they fought so hard to win in December 2002;

Whereas the hypocrisy of those who were vying for leadership under the NARC umbrella has been exposed and we now know that they were never anti-corruption crusaders after all, and it is those of us with the interests of our country and our people at heart who must make sure that Kenya does not go back to the pre-2002 years, and we, therefore, have a solemn national obligation to look beyond individual leaders and eschew their cheap stratagem of recoiling into tribal cocoons when they are caught red handed and ensure that Kenya stands as one strong nation that will never tolerate the misuse of state machinery and government resources, for furtherance of personal, criminal interest;

Whereas Kenyans are extremely troubled, and indeed disillusioned, by the
barbaric, arrogant and defiant act of a few public officers mobilizing state
resources for what amounts to criminal activity in attacking the offices and
printing press of the Standard Media Group, an act that not only sends chills
down the spines of law abiding Kenyans, but also projects Kenya in the eyes of civilized members of the international community as a barbaric nation without the slightest sense of basic human decency, a situation that is in sharp contrast with the euphoria and hope that greeted this government’s election, and the accolades that it continued to receive from all over the world;

Whereas one must wonder if the leaders in this government care for the image of the country or if they are so determined to even personal scores that the country they swore to protect no longer matters;

Whereas Kenyans must demand that the government exhaustively, expeditiously but fairly brings to a closure all cases of scandals that have emerged during and prior to its ascendance to power and that government leaders should not hoodwink Kenyans by laying more, undue emphasis on some cases to protect their cronies involved in others, and Kenyans must be told why reports of commissions of inquiry that had been gathering dust on bookshelves are now suddenly overshadowing cases of and investigations into current scandals;

Whereas Kenyans want to see the government address and settle the following
scandals in order of preference:
1) Anglo Leasing-type scandals, both security-related and otherwise
2) Goldenberg scam
3) Findings of the Ndung'u Land Report
4) All other scams that have deprived Kenyans of their resources

Whereas, following findings of investigations into the above, all indicted and
convicted persons should be forced to relinquish illegally acquired property in
addition to receiving appropriate sentences for their crimes, and in addition
posthumous acquisitions should be repossessed in the interest of the public, and, indeed, such convicts should be banned from holding any public or elective office for life;

Whereas we wish to emphasize that this effort is intended to focus attention on
the real issues facing our country, which has been riddled with corruption since
1963 when we attained self governance; we cannot continue hiding the wounds that selfishness has inflicted on us; and we must admit our mistakes and heal the wounds so that we can progress as a country;

And whereas we are at a watershed moment with NARC that requires bold actions and we should not be afraid to acknowledge obvious mistakes and theft that have occurred;

We, the undersigned, therefore, earnestly petition Hon. Mwai Kibaki, the
President and Commander-in-Chief of the Armed Forces of Kenya to ensure that:
A.        All involved in or were accessories to the barbaric act of raiding the
Standard Media Group premises commando-style are relieved of their public offices and prosecuted for their roles in misuse of government resources to perpetrate a most heinous crime
B.        The Government of Kenya aggressively pursues and brings to justice ALL involved in scandals designed to rob the government and people of Kenya of billions of shillings through public procurement scams; and that the Anglo Leasing scandal be resolved first;
C.        Prosecutions of the culprits in (b) above are public and the process is
transparent;
D.        No individual, public or private, is exempt from the due processes triggered by (a) and (b) above
