CONSTITUTION REVIEW: Reject the NARCK-K and ODM Kenya Games

  How are you my brother.
 
  I have read your one sided piece and while I agree with the paining you have
given of the Kibaki regime, I find it myopic to the extent that you do not see
that the problem at hand is the constitution and not Kibaki. We suffered all
these and more under Moi, Kenyatta. The problem is the system and you better know that Kenya no longer needs a new President but a new democratic First, then the people to lead refroms under a new Katiba. The 96%, 98%, 94% skewed appointments you have articulated are a result of this constitution. I want and I am demanding that we get our priorities right;
 
  Whether such travesty and criminal appointments are done by Kenyatta, Moi,
Kibaki or Raila they are just wrong and criminal.
 
  That is why I pleaded with Hon. Kajwang that walking out from the MRSF at KICC was basically to dance to Martha Karua's hands. Kajwang and Dalmas did exactly- walk out.These issues do not require that we see them and feel them with our emotions but foresigght. 
 
  Of course Martha came down to KICC with proposals to provoke ODM to walk out so that there is no new constitution to end this gross abuse of power under this Njonjo- Moi-Kibaki-Mboya-Kenyatta constitution. NARC Kenya and Kibaki are not for a new constitution. But what about ODM-Kenya?
 
  So ODM walked out. And Martha thought she had carried the day so that she may then walk out and tell Kenyans that at last we can not have a new constitution since ODM has walked out. But she did not succeed. Because constitution making is such a political issue that has made all of us swear that politics - constitution making- is too serious to be left to ODM and NARC Kenya. Those small games ODM and NARC Kenya are playing must be rejected. 
 
  SO we stuck in there and said YES, if you Martha are serious then take the
Constitution review Bill and Amendments to entrench the process and the
referendum to Parliament. The government simply accepted the noose. Now they must bring the review Bills to Parliament so that the country pursues a new
constitution. Of course ODM will be waiting to shoot everything down because of ECK, EALA etc. My brothers in ODM never stop amazing me by their short sightedness. If you leave Kibaki with this Njonjo-Kenyatta constitution, what do you expect? They will do it again.
 
  By the way I do not agree with ODM's tactic at all. if some one is using a bad
constitution to appoint Kikuyus and cronies to power everywhere, what should be your priority? To walk out or to go all out looking for a new constitution that
empowers parliament to vet appointments? Some one at ODM is operating with a simplistic understanding that ODM-K will win the next poll without doubt.
 
  How are they going to win the next election when they have left the government to operate under this current constitution which gives Kibaki all the advantages?
 
  And then secondly, who told me that ODM-K itself is for a new constitution?
There is no evidence whatsoever. You can not campaign for a no vote and win with me out there flat on my chest mobilizing for the NO vote then you turn around and call for Minimum reforms instead of the whole comprehensive Katiba. This is where ODM goofed and this I told my friend Hon. Ken Marende that politically ODM goofed and gave Martha Karua her life line. ODM must take responsibility on this.
 
  The point OTO is this, if you want Minimum reforms, you call for comprehensive reforms and give an ultimatum .. say for example.. within three months.. And since government can not deliver comprehensive reforms and they are not a new constitution [we all know Kibaki] they will negotiate for substantive minimum reforms and there you are, you win for all Kenyans.
 
  But since ODM goofed, they have missed all the minimum reforms and
strengthened the hand of Kibaki.
 
  OTO, stop misleading ODM. Tell our brothers to stop the haste and strategize.
Period!
 
   In the words of Museveni, stop agonizing, start organizing.... and by the way
rallies are not organizing; Organizing is;
  - Doing the Party Programme
  - fixing the structures
  - fixing the membership
  - fixing the secretariat and think tanks for ODM not for Raila, Kalonzo etc
separately
  - Defining resource bases including in civil society
  - Doing the campaign teams to stop the rigging.
  - Fixing the media- some of you have been fooling us that Standard is for ODM, are you kidding me? What is Moi's agenda?
  - Shedding off the tag of the corrupt, the tribalists and the sycophants etc.
  - Getting the youth thing, the Women identity, the workers platform etc right.
 
  Let us know that we are going to a very serious elections and these guys in
government are gonna do lots if we do not take over the constitution reform
project from Martha Karua and drive it. You underrate your opponent at your own peril..
 
  Personally I want a new constitution badly but only if it is made by the people of Kenya and it is democratic and meeting the highest standards of accountability, just governance of the nation, secures rights, limits government, separates and provides strong checks, secures community, minority and group rights, Devolves power tom my mother in South mugirango etc.
 
  For me this is more important than a new president; I know that Kibaki will be  voted out by the people [ I think]. But then Oto you must stop and listen to me because I know what Kibwana my co-convener of NCEC is today under this constitution; If you think Raila, Kalonzo will come by your bedside to tell you about justice and land reforms, about Equality and so on and so forth  then wake up and smell the coffee; Get the constitution and we shall end the Mathare strives; Ask the Njemps and Ilchamus, they are in court saying they were never represented since independence; What has Ruto, Raila, Kalonzo, Balala, Jebii, Julia Ojiambo, Magara or ODM said so far? What have they said about the 6000 retrenched workers of Telkom, 4000 Railways, 6000 EPZ;

administration, 94% in state security apparatus, 96% at the judiciary, and 98% at all those political anti corruption bodies.

Hence, what Kenyans do and say does not bother them.  What can move this man is the kind of move by the ODM-K team in walking away from that multi sectoral circus. And ODM-K must now mobilize Kenyans to see this government for what it is; a government of tribalists, corrupt individuals and those who have no regard for Kenyans.

We basically mean nothing to this regime. Thats why mungiki can kill Kenyans in Mathare, and the regime is not moved; Kenyans are dying in Kuresoi, and no one bothers.

ODM-K must preach the gospel to all those other Kenyans who have not seen the light, those Kenyans who still believe that we have witnessed some imaginery 5.8% economic growth. This is some phantom, only known
to HE and his team.

Time has come for Kenyans from all walks of life to ask those Nyong'o kind of questions. We must be told clearly how Central Bank made a loss of Kshs 4.8billion last year, the same year Equity Bank went into unprecedented expansion. This is also the time that group, Trans Century, started rapid economic expansion.

Kenyans must be told, and ODM-K must ask, is there any corelation between the loss at Central Bank and the activities of these two groups?

Kenyans must be told, and ODM-K must punch holes into the 5.8% economic phantom, for we do not see it. I do not see or feel that growth when am buying bread, milk and sugar for breakfast. I also do not see the same when I am buying sukukawiki, meat, unga, rice and parafin for lunch. I still do not feel the same when   I board a matatu to work, put fuel in my car, or go to the garden.

So who feels, or rather, who enjoys my bit of the 5.8% economic growth, if am not enjoying it myself? The person enjoying that growth on my behalf can glorify its reality.

Kenyans must be told, and ODM-K must punch holes into that imaginary Free Primary Education. The cost of FPE to Kenyan parents is choking, choking to an extent where most pupils who went to school thinking that it was free, have all fallen by the road side. Kenyans must be told that FPE is a fiasco, managed by a cabal from one province at the ministry of education.

Kenyans must be told, and ODM-K must demand to know whose interest Steadman works for. Kenyans must not falter to this engineered manipulation with eyes set firmly on December 2007.

ODM-K must put this government on its toes because a government that cannot protect her citizens from thugs and bandits, does not have any business telling us that the economy is doing well.

Doing well for Who?

Doing well for those being killed in Mathare, Kuresoi, Molo, Turkana? Doing well for those whose houses are being broken into, burnt daily, and being car jacked on our roads? Or those parents whose kids are being raped daily, or those Kenyans who spend 3hrs on the road daily driving from Komarock to town, 15 kilometers away?

This must be a joke for it is sad, very sad, to see innocent mothers with thier children being rained on in front of a military barracks, and this feel good
government, is happy telling us about 5.8% economic growth.

Kenyans must know, because ODM-K must ask.

THERE has been a lot of acrimony over the constitutional review in the recent past. And Prof Ghai has taken a lot of flak from kiraitu, muite, the multi talented kamau kuria, koigi, mirugi, murungaru and strangely from Joseph Munyao.

At the same time, Prof Ghai has received support from Kalonzo, Raila and other voices of reason. What must be worrying most Kenyans is the tone of Kiraitu and his backers. The arrogance with which Kiraitu opperates is simply beyond redemption. The man has great contempt for Kenyans that he abrogates unto himself the power to be the only person who knows what the law is. And at the same time he gets blind to the fact that Kenyans can see through his tribalistic inclinations. He has appointed the multi talented Kamau Kuria to almost any job available. He has appointed Kathurima M'noti to chair something. He has appointed Aaron Ringera to probe Judges and is now fronting for him to be the Director of KACA. All these peaple were his partners at his law firm. And this is the person now with the moral authority to spite Kenyans.

It is really sad that Murungi can find fault with Prof Ghai. This is simply an open scheme to derail the constitutional process. But the only consolation Kenyans now have is that Raila by declaring Kibaki tosha, has managed to expose the kikuyu greed to all other Kenyans.
