Fwd: Re: [Jambo] Oto: the Three dimensions to the Katiba siasa

Orina,

When we bamped onto each other the other day, some issues came out more clearly, issues which can re-allign my thinking.
1] ODM-K must not boycott the constitution sitting. They must stay put and push the ball to Kibaki's court.
2] ODM-K must push for the immediate independence of parliament, so that parliament can take charge of its own calender.
3] ODM-K must push for the entrenchment of the review law into our constitution immediately.
4] ODM-K must fight for the independence of the ECK, and have that entrenched in the constitution, with clear mechanisms of nominating members to the commission.

Running away from the constitution committee will give the Narcists some breathing space to enable the say that they wanted to give Kenyans a new constitution, but ODM-K refused.

Let us make this a water tight issue beneficial to all Kenyans, devoid of class and political interests.

Lastly, I will still maintain, if we cannot do it right this time around, then lets put into office, one who has championed the struggle and fought all wars with us, sufferd for our course, and even got jailed for the course.

We must put into office someone whose mere presence in the scene, sends thieves scumpering for safety, and even into exile.

Cerelac presidents would not make any difference.

Oto,
You remember our sharing off the email.

There is nothing like a constitution after elections. Jaramogi and Matiba Said-
Elect us since we have dealt with section 2A we give you a new constitution; Moi beat them;
Then came Kibaki in 1997; He led the opposition in lying to the people- elect us on the strength of IPPG, after January we shall give you anew Katiba;

Then 2002- elect NARC, once we are in Kibaki will be president for just one term and then within 100 days you will have a new constitution; nothing- it was a lie;

Now ODM has began the spent lie- that you should elect ODM to give you a constitution after we are in state house; this is a white lie; You should lead the people of Kenya in telling ODM and Kibaki?s NARC Kenya that NO KATIBA, NO elections;

So you see there are three DIMESNIONS to this Katiba Struggle;

The NARC- Kenya Government dimension
The ODM and opposition parties dimension
And then there is the People of Kenya?s National interest dimension
Oto, elections never bring about change of structures and systems; so you see after Moi, Kibaki has perpetuated the system of excluding the rest of Kenyans and fattening the elite; who tells you another election will challenge the status quo please! Are you kidding us?

If a new man comes to state house, the constitutional reform will wait until 2012 or never again be touched.

If, God forbid, Kibaki gets his second term, [and any way you seem to joke with the extent of the conservative nature of the Kenyan electorate which is just 30 points worse than the American voters] then you are really waiting for problems.

Oto we have a very conservative electorate;

People normally genuinely ask why Kenya's reform Movement links elections with Katiba Mpya; Here are the answers;
- Elections allocate power to different people- different office holders- it is a formula for regime change.
- a new constitution allocates power differently [ systems and structural change]
- And if it is an electoral issue like it will continue to be in Kenya until we finally have a sustainable constitutional settlement, those who are for it will gain power and those who are against it will lose power. These issues are about allocation of power; what power to whom through which formula?
- Constitutional reform is to us in Kenya what the Iraq War has become to the US and Europe. From Spain to, German, Italy and now Britain and other countries, those Prime Ministers who endorsed the murder of people in Iraq and the throwing away of good money to a senseless overthrow of a legitimate government [ so called war as if the Iraqis fought the Uncle Sam invaders] have been thrown out of office.. If you are against the comprehensive review of the current Nyayo constitution which has been used to humiliate, annihilate, deprive, oppress, pauperize and exploit the millions of our people AND if you are heard to be suggesting the postponement of dealing with our problem, you take the caning;

Cyprian Orina Nyamwamu
