PROF. ANYANG' NYONG'O IS NOT THE REGISTERED BONAFIDE ODM (K) SECRETARY GENERAL

If Orange Democratic Movement of Kenya (ODM-K) party remains united before and after nominating its presidential candidate, then this is the party to beat come the next general elections slated for December 2007 or thereabout.

It is the party to beat because of its national representation, outlook, policy, youthful and educated leaders, fanatical followings and radical and aggressive leaders. For now, I can but wish them all the best.

However, even every Dick and Harry of Kenyan politics knows that all is not well within the ranks and file of this hitherto vibrant party. That is visibly so because the ODM(K) top party mandarins behave like the Biblical Pharisees. Indeed, most of them are, who preach water but drink wine, modern day chang’aa in Kenya. They always sing democracy, democracy, democracy, yet they all nurture hidden dictatorial tendencies.

According to records held at the office of the Registrar of Societies, the officially, repeat, officially registered Secretary General of ODM (K) is Mr. Abraham Chepkonga Kibet. The other registered officials of ODM (K) are Mr. Daniel Kitonga - - Chairman, Mr. Ronald Ochieng' - - Vice Chairman, Ms. Lilian Aluga - - Treasurer, Ms. Margaret Nyakundi - - Women Leader and Mr. Muinde John Mutungwa - - Youth Leader. ODM (K) registered address is in Hurlingham along Argwings Kodhek Road.

However, the holier than thou chang’aa as opposed to water drinkers will tell you the ODM (K) Secretary General is none other than Prof. Anyang' Nyong'o. Prof. Nyong'o is also neither ashamed nor shy to advertise in the press that he is ODM (K) Secretary General but operating at Orange House, Vanga Road, Valley Arcade in Nairobi. I wonder whether these are deliberate attempts to confuse ODM (K) supporters even further. But these open lies will not take the party to Canaan.

Many ODM (K) supporters I spoke to are totally confused when it comes to the position of officially registered office bearers. Does ODM (K) have two official Secretary Generals operating in two different office locations? Who amongst Hon. Henry Kosgey and Mr. Kitonga is the official ODM (K) Chairman? And if so, why do they operate in two different party offices? ODM (K) top mandarins must answer these questions now.

If Hon. Peter Anyang' Nyong'o is not the registered ODM (K) Secretary General, how does he expect party members to obey his ambiguous orders and instructions? Is it not illegal for a non registered party Secretary General to issue orders, instructions, circulars and threats on behalf of a registered party? Legally speaking, who in any party, including ODM (K) should issue threats, orders and instructions on behalf of a party if it is not its registered officials?

Because of the academic background of the many ODM (K) top brass, many Kenyans thought they know what to do and act within the laws of the land and their own party. Alas, that is not the case any more. A none registered official of the party in the name of the learned Prof. Nyong'o is busy issuing threats, orders and signing circulars on behalf of the party. In ODM (K) politics, it is not the game of numbers and officialdom but a game of the absurd and imposition.

The first threat and order Prof. Nyong'o gave was that not every ODM (K) member should go to funerals and start shouting ODM, ODM, ODM! The second is his press circular Notice to ODM (K) members concerning Interim Constituency offices, issued from a different ODM (K) office. How and why does a party of the day to beat allow these important functions and directives to be issued by a quack Secretary General? What weight and consequences do orders and directives issued by a quack party Secretary General legally mean to party members? The answer is NOTHING ! NULL AND VOID!!

ODM (K) must put its house in order first. The party enemies can easily capitalize on the laize fair actions of its quack Secretary General to block its activities. They will start with simple but crucial illegal circulars recently issued by Prof. Nyong'o. Even ODM (K) interim officials elected and selected using Prof. Nyong'o's illegal circulars can be easily blocked from assuming office through a court of law. I wonder whether ODM (K) luminaries are seeing this or not.

I am sure disgruntled ODM (K) members will capitalize on this to block even the much awaited presidential elections. Prof. Nyong'o will be to blame for this political quagmire.

A circular issued by a none office holder (quack for that matter), is totally absurd, illegal and repugnant. Any office bearer selected and elected using such an illegal circular is also holding that office illegally. Even an annual delegates conference convened by illegal delegates who were selected through an illegal circular is simply null and void. Hon. Kajuang' the ODM (K) soloist per excellence knows this very well, but is dancing all the way to Mbita and Kisumu, displaying an illegal circular issued by a quack Secretary General Prof. Anyang' Nyong'o.
