Blood shed in Kenya

To:- Hons. Raila Odinga, Mudavadi, Anyang' Nyong'o, Ruto, Joe Nyaga, Mrs. Ngilu and Dr. Mutua:

May I take this opportunity as a staunch ODM supporter to thank the ODM leaders for the hard work and strong stand youhave taken to bail Kenyans out of the oppression of ruthless leadership. I also wish to highlight a few points for those who are not well informed like Dr. Mutua;

(1) In 1966 during the fall-out between Jaramogi Oginga Odinga's KPU and Kenyatta's KANU, the late Tom Mboya rushed a bill in parliament when he realised that there was going to be a vote of no confidence in the government, as MPs were crossing the floor to join KPU. The bill was passed hurriedly and made into law which states that, and i quote " AnyMP who crosses the floor from his/her party to join another party will seek new mandate from his/her constituents". Is it still in force, and if so why do MPs move from party to party as they wish at present? Does it not apply to Kalonzo and others? And what action is being taken to follow the Constitution to the letter?

(2) In 2002 Moi advised Narc members to defer the general elections to April 2003 while waiting for a new constitution which would pave ways for coalition government. Narc members declined that a new consitution would be given to Kenyans in 100 days. So Narc formed a loose coalition based on marriage of convenience, ignoring the present constitution which says that the winner takes it all -meaning that the party with the majority forms the government. Why is the constitution ignored? Uhuru Kenyatta and Kanu MPs were not smart in that since Kanu had more seats, followed by LDP in 2002 election he would have stopped Narc from forming a government because that type of government had not been approved by parliament.

(3) If we go by the present constitution by analysis, ODM has 100 seats and PNU has 43, so automatically ODM should form the government. On presidential election even a blind person can tell that ODM's Raila won. Numericaly, who is stronger? Does it mean that if Kibaki beat Raila on presidential election (which he stole) but his party worn only 20 seats in parliament he could still be president? How could he form a government with less than half the number of MPs? This section of the constitution needs to be amended to read that "a candidate with the majority of seats in parliament and qualifies in 5 provinces will form the government".

It is obvious that Kaparo knew about all these loopholes but he sat on them purposely, which has now led to all this blood shed. The so called government should not accuse the opposition of igniting the blood shed. It should be noted that Kenyans know where the truth lies and the recent killings of ODM MPs is the work of government whatever lies they tell to cover up, Kenyans are fed up with Kibaki and and his toothless cliques of deadwood who are only interested in protecting their loots, the likes of Saitoti, Biwott, Moi and his sons Michuki, Uhuru Luci Kibaki etc. Kalonzo has let the whole nation down and he should realise that he has no name worldwide. Kivuitu and the ECK members who were selected by Kibaki has the blood of Kenyans who died on their heads and they will soon face the wrath of GOD.

Last but not least, PNU says that ODM should go to court knowing very well that they control the judiciary who will only sing their filthy songs in all cases concerning the election. We could go on for days enumerating the cases which they have handled to kill justice. At the moment there is no timescale when courts should hear and decide petition cases, so any complaint would be considered contempt of court when still pending, and which would take even 5 years or more, like 2002 petition cases which are still pending up to now. So what is the use of going to court. Mutua should tell the country why Livondo's is being rushed, and what he goes to do at Harambee House every day if not to be briefed of what to do? Mutua, you are still a young man, but if you dont' watch your steps and utterances, you will live to regret, as things will soon change for the betterment of Kenyans who are now crying to GOD to save them.
