Going to court is an option that will not give Kenyans justice that they so rightly want and this is why.

The incumbent president has demonstrated to Kenyans and the whole world that he does not respect the independence of institutions.

He summoned the Chairman of ECK ("an independent institution") Mr. Kivuitu and forced him (Kivuitu) to announce the inconclusive presidential election in his (Kibaki) favour.

The judiciary from AG Mr Wako to Judges who might preside over the case were it to go court are all his appointees. How can he (Kibaki) and his followers convince an ordinary Kenyan that he will not manipulate Judges or just order them to delay the case until his term finishes?
