ODM SHOULD WITHDRAW FROM THE MEDIATION


The effort of mediation between ODM and PNU under the auspice of the imminent Africa persons may flop because it was started and is treading on the wrong foot.

The former UN-Secretary led team failed to lay from the beginning foundation of the mediation on a solid level ground for an immediate restoration of democratic and human rights to all Kenyans.

The road-map tabled by the Mr. Kofi Annan does not reflect the Kenyan social, economical and political crisis chronological events, which plunged our country to unprecedented sufferings, lose of properties and lives, but is a window dressing with very little cure to an already diagnosed disease. 
Mr. Annan is offering a pain killer instead of full treatment for the Kenyan political pandemic.

The mediators must confront the illegitimate Government of Kibaki with practical demands from Kenyans for a new Majimbo-constitution spelled in Bomas Draft, instead of majoring in minor humanitarian and diplomacy approach.

Therefore, ODM should withdraw from the mediation until these two conditions are met:

1) An immediate enactment of the Bomas Constitution draft by the parliament with immediate effect to pave way for the formation of a transition government.

2) Setting up the date of Presidential re-run within a frame work of 6 months under a new constitutions framework. The Orange Democratic Movement (ODM) must forthwith insist on these 2 items to be met or withdraw from the mediation until democratic and human rights are restored to Kenyans.

The current atmosphere of the ongoing mediation gives the illegitimate Kibaki government an upper hand to manipulate the democratic and justice fundamental principles.  Therefore, for it to succeed, these negotiations must be done under the new Bomas Draft Constitution.  Otherwise, these negotiations are doomed to fail.

ODM has been held at ransom by the PNU corrupt wealthy elements working with a hidden agenda to undermine their effort to bring about true change. ODM owes all Kenyans who have been and are still being massacred in cold blood by government security agents and the Mungiki militia group while demanding their democratic rights. Their deaths should not be downplayed but should be the justification for ODM to deploy a real democratic formula in the mediation.

The current pattern dictatorship being applied by Mr Kibaki is no less than that of the late Kenyatta and Moi regimes where Kenyans lived under 24 hour police surveillance and terror, politicians assassinations at will, defenseless innocent Kenyans massacred en masse without justice, while the world watched.

Kenya has been taken back to the 1960’s to 1990’s when there were no freedom of press, association, or assembly and when human right abuses were rampant.

If the late Jaramogi Oginga Odinga, the doyen of opposition, would come out from his grave today, he will take us back to the street until the hard earned democratic rights are restored back to the Kenyan people.

We urge the international community to enforce sanction and freeze all the accounts of all the corrupt Kenyan government’s officials and their cronies to save the dying democracy and rule of law in Kenya. Mr. Kibaki has proven to be dishonest following his arrogant speech at the AU and, therefore, he should not be trusted but should be forced to step down.

The African continent is grooming a new generation of dictators who want to cling to power through massacring their own citizens, by the loyal brutal security agents, the scene witnessed in the pre-independence era at the peak of the Cold War.

Kenyans did not vote for a new government but rather voted for ODM to bring about the long awaited Majimbo government to enable them work and build up a strong social and economic democratic federal government in their respective regions, the position which the majority of Kenyans have died for, are still dying for and will die for until justice prevails.

We also call upon all ODM MP's to facilitate the evacuation of the displaced persons in all the anti-Majimbo provinces to their ancestral homes to avoid the Mungiki militias from further massacring the Luos, Kalinjins, Luhyas, Massais and many others who supported ODM-Majimbo government.
